Welcome to Dash.

These Terms of Service (“Terms”) set out the agreement between you and Dash regarding your use of the Dash website, mobile application and related services (“Services”).

By creating an account, accessing or using Dash, you agree to these Terms. If you do not agree with these Terms, please do not use our Services.

1. Who We Are

In these Terms, “Dash”, “we”, “our” and “us” refer to Campbell Ruby Ltd.

“You” refers to the person accessing or using our Services.

2. What Dash Provides

Dash provides digital tools, information and AI-powered features designed to help dog owners care for their pets.

Our Services may include:

·         AI-powered dog care advice

·         Dog profiles and health tracking

·         Food and feeding calculators

·         Food safety information

·         Walk and weather guidance

·         Photo recognition features

·         Veterinary practice search tools

·         Educational articles and resources

·         Premium subscription features

We may add, remove or change features from time to time to improve the Services.

2A. Eligibility

You must be at least 18 years old to create an account or purchase a subscription to Dash.

If you are under 18, you may only use Dash with the involvement and consent of a parent or legal guardian.

By using Dash, you confirm that you meet these requirements.

3. Not Veterinary Advice

Dash is designed to provide general information and support responsible dog ownership.

Dash is not a veterinary practice and does not provide veterinary diagnoses, medical treatment or professional veterinary advice.

Information provided by Dash, including AI-generated responses, calculations and photo recognition results, may be inaccurate, incomplete or unsuitable for your particular circumstances.

You should always seek advice from a qualified veterinary professional if:

·         your dog appears unwell

·         symptoms worsen

·         your dog has eaten something potentially dangerous

·         you are unsure about the seriousness of a situation

·         you are concerned about your dog’s health or wellbeing

You remain responsible for decisions relating to your dog’s care.

4. Emergency Situations

Dash is not an emergency service.

You should not rely on Dash or wait for an AI response where your dog may require urgent veterinary attention.

Examples of emergencies include:

·         difficulty breathing

·         collapse or unconsciousness

·         seizures

·         severe bleeding

·         suspected poisoning

·         ingestion of toxic substances

·         severe trauma

·         repeated vomiting with signs of illness

·         inability to urinate

·         any condition that appears life-threatening

In an emergency, contact your nearest emergency veterinary practice immediately.

4A. Artificial Intelligence Features

Dash uses artificial intelligence technology to provide personalised information and recommendations.

You acknowledge that:

·         AI-generated information may contain errors

·         responses may not always be accurate or complete

·         AI may misunderstand information provided by you

·         photo recognition may incorrectly identify objects, plants, foods, animals or other items

·         recommendations should be considered alongside your own judgement and professional advice where appropriate

Dash does not guarantee the accuracy, reliability or suitability of AI-generated content.

4B. Appropriate Use of AI

You agree not to:

·         rely on Dash as a replacement for veterinary advice

·         use Dash for emergency decision-making

·         attempt to manipulate, exploit or misuse AI features

·         upload unlawful, harmful or malicious content

·         use Dash in a way that damages, disrupts or compromises the Services

We may restrict, suspend or terminate access where AI features are misused.

5. User Accounts

When creating an account, you agree to:

·         provide accurate information

·         keep your login details secure

·         maintain accurate information about your dog where applicable

·         notify us if you believe your account has been compromised

You are responsible for activity carried out through your account.

You must not:

·         share your account where this is not permitted

·         impersonate another person

·         attempt to gain unauthorised access to Dash

·         interfere with the security or operation of the Services

6. Acceptable Use

You must not use Dash:

·         for unlawful purposes

·         to upload harmful software or malicious code

·         to infringe another person’s rights

·         to copy or extract our Services without permission

·         to interfere with other users’ access to Dash

7. Photo Recognition

Dash may allow you to upload photographs for identification or safety guidance.

By uploading photographs, you confirm that:

·         you have the right to upload them

·         the images do not infringe another person’s rights

·         you understand results are estimates only

You acknowledge that photo recognition technology is not guaranteed to correctly identify items.

Photo recognition should not be relied upon as a definitive safety assessment, diagnosis or replacement for professional advice.

8. User Content

You retain ownership of content you upload to Dash.

By uploading content, you grant Dash permission to process, store and use that content only as necessary to provide and improve the Services.

You remain responsible for all content uploaded through your account.

9. Subscriptions and Payments

Some Dash features require a paid subscription.

Payments are processed securely through Stripe.

Subscription pricing will be displayed before purchase.

Unless otherwise stated:

·         subscriptions renew automatically

·         you may cancel your subscription at any time

·         cancellation prevents future charges but does not usually refund the current billing period unless required by law

9A. Consumer Cancellation Rights

If you purchase Dash as a consumer, your rights are protected under applicable UK consumer protection legislation, including:

·         the Consumer Rights Act 2015

·         the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

Where digital services begin immediately after purchase, you may be asked to confirm that you wish the service to begin immediately and acknowledge that this may affect your statutory cancellation rights, where permitted by law.

Nothing in these Terms limits your statutory consumer rights.

10. Free Trials

If Dash offers a free trial:

·         the trial period will be clearly explained before sign-up

·         your subscription may automatically convert into a paid subscription unless cancelled before the trial ends

11. Availability of Services

We aim to keep Dash available and reliable but cannot guarantee uninterrupted access.

The Services may occasionally be unavailable due to:

·         maintenance

·         updates

·         technical issues

·         third-party service interruptions

·         circumstances outside our reasonable control

12. Third-Party Services

Dash relies on certain third-party services, which may include payment providers, AI providers, hosting providers and other technology services.

We are not responsible for the availability, performance or policies of third-party services.

Separate third-party terms and privacy policies may apply.

13. Intellectual Property

All Dash content, branding, logos, designs, software and materials are owned by Campbell Ruby Ltd or licensed to us.

You must not:

·         copy

·         reproduce

·         modify

·         distribute

·         commercially exploit

Dash content without written permission.

14. Limitation of Liability

Nothing in these Terms excludes liability where such exclusion is not permitted by law.

Dash is provided on an “as available” basis.

To the fullest extent permitted by law, we are not responsible for:

·         decisions made based on Dash information

·         veterinary expenses

·         injury, illness or loss relating to your pet

·         indirect or consequential losses

·         loss of profits

·         loss of data

·         interruptions caused by circumstances outside our control

Our total liability to you shall not exceed the amount you have paid to us in the 12 months before the event giving rise to the claim.

14A. AI Disclaimer

While we work continuously to improve Dash, we do not guarantee that AI-generated responses, recommendations, calculations or image recognition results will be accurate, complete, current or appropriate.

AI systems may produce incorrect or misleading information, including information presented with confidence.

You use AI features at your own discretion and risk.

Responsibility for decisions relating to your dog’s health, safety, diet, medication or treatment remains with you.

Where appropriate, you should confirm information with a qualified veterinary professional.

15. Indemnity

You agree to compensate us for losses, claims or expenses arising from your breach of these Terms or misuse of the Services.

16. Ending Your Account

You may stop using Dash at any time.

We may suspend or terminate access if:

·         you breach these Terms

·         fraudulent activity is suspected

·         continued access creates a security or legal risk

Where practical, we will provide notice.

16A. Data Retention Following Account Closure

When you close your account, we will delete or anonymise your personal information in accordance with our Privacy Policy and applicable data protection laws.

We may retain certain information where necessary for:

·         legal obligations

·         regulatory requirements

·         fraud prevention

·         legitimate business purposes

Any retained information will only be kept for as long as necessary and will remain protected.

17. Privacy

Our Privacy Policy explains how we collect, use and protect your personal information.

By using Dash, you acknowledge that your information will be processed in accordance with our Privacy Policy.

18. Changes to These Terms

We may update these Terms from time to time.

If changes are significant, we will provide reasonable notice through the website, app or email.

Continuing to use Dash after changes take effect means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of Scotland.

Any disputes will be subject to the jurisdiction of the Scottish courts, except where consumer protection laws provide otherwise.
